The SecuROM DRM that comes packed with the Spore games now ignited a very nasty class action lawsuit against Electronic Arts.
The lawsuit was filed in U.S. District Court by Maryland resident Melissa Thomas. In her filing, Thomas accuses Electronic Arts of unlawful and deceptive conduct and targets the automatic installation of SecuROM.
The DRM software, she complains, is installed without asking the user for confirmation. Furthermore, the user can't remove such software when uninstalling the game, as Electronic Arts failed to provide the necessary tools.
SecuROM, the filing states, is "secretly installed to the command and control center of the computer (Ring 0, or the Kernel), and surreptitiously operated, overseeing function and operation on the computer, preventing the computer from operating under certain circumstances and/or disrupting hardware operations."
In conclusion, the court is asked to OK the following demands: disgorgement of unjust profits and damages for trespass, interference, unfair competition and consumer law violations.
